Terms and Conditions
Welcome to Edukitor ("Edukitor," "the Platform," "we," "us," or "our"), a school information system operated by Gabriel S. Sacro, an individual based in Surigao City, Philippines. These Terms and Conditions ("Terms") govern access to and use of the Edukitor platform, including its website, dashboards, and related services (collectively, the "Service").
By creating an account, logging in, or otherwise using the Service, you ("User," "you") agree to be bound by these Terms. If you do not agree, please do not use the Service. If you are a parent or guardian creating or managing an account on behalf of a minor student, you confirm that you have the authority to do so and agree to these Terms on that student's behalf.
For most Users, this agreement is captured explicitly rather than merely assumed from use — a required checkbox when an account is created, or a one-time confirmation screen shown the next time you reach your dashboard if these Terms have changed since you last agreed. We keep a timestamped record of that agreement, including which version of these Terms it covers.
1. What Edukitor Is
Edukitor is a software tool that helps schools manage day-to-day academic and administrative records — such as enrollment, attendance, grades, schedules, and tuition tracking — for their own students, staff, and families. Edukitor is provided to schools ("Client Schools") as a software service. Each Client School, not Edukitor, is responsible for the accuracy, completeness, and lawful basis of the information it enters, uploads, or manages using the Service about its own students, parents, and staff.
Edukitor does not independently verify academic records, attendance data, payment amounts, or any other information entered by a Client School or its authorized users. We provide the tool; the school remains responsible for what goes into it.
2. No Payment Processing
Edukitor is not a payment processor, e-wallet, or financial institution, and does not hold, transmit, or take custody of any funds. Where the Service references or displays a GCash or similar payment option, this reflects a manual, peer-to-peer transaction conducted directly between a parent/guardian and the Client School, entirely outside of Edukitor's systems. Any confirmation, receipt number, or transaction reference shown within the Service is a record entered by school staff for the school's own bookkeeping convenience — it is not proof of a completed transaction on our end, and not a substitute for the school's own official receipt.
Edukitor is not responsible or liable for any payment dispute, delay, error, fraud, chargeback, or misdirected transfer relating to a payment made outside the Service.
3. Physical Recordkeeping Is Required
The Service is a digital convenience tool. It is not a substitute for the physical, hard-copy records that schools, teachers, registrars, and cashiers are already required to keep under Philippine law and Department of Education (DepEd) regulations — including official receipts / sales invoices, Form 137 / Form 138 records, enrollment documents, and attendance logs.
Client Schools and their staff are solely responsible for maintaining these physical backup records. If the Service becomes unavailable, is interrupted, suffers data loss, is compromised by unauthorized access, or is discontinued for any reason, the physical records kept by the school remain the authoritative and legally required record. We strongly recommend that no school rely on the Service as its sole record of any academic, attendance, or financial information.
4. Acceptable Use
You agree to use the Service only for its intended purpose — legitimate school administration — and not to:
- misrepresent your identity or role;
- access or attempt to access data you are not authorized to see;
- interfere with the security or normal operation of the Service; or
- upload unlawful, harmful, or infringing content.
We may suspend or terminate access to any account we reasonably believe violates these Terms or poses a risk to the Service or its users.
5. "As Is" Service — No Warranties
Edukitor is under continuous development. We are always working toward optimizing and automating the Service for the benefit of all users, but we make no promise, representation, or warranty — express or implied — that the Service will be uninterrupted, error-free, secure, or fit for any particular purpose.
The Service is provided on an "as is" and "as available" basis, relying on currently available software, tools, and third-party infrastructure. We do not guarantee any specific outcome, uptime, or level of accuracy, and reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
6. Assumption of Risk and Limitation of Liability
By creating an account or otherwise using the Service, you acknowledge that use of any internet-connected software carries inherent risks — including unauthorized access, data loss, service interruption, and technical error — and you voluntarily accept these risks.
To the maximum extent permitted by Philippine law, Edukitor's total liability for any claim arising from your use of the Service shall not exceed the amount (if any) you personally paid to Edukitor directly in the twelve (12) months preceding the claim — which, since the Service is provided to schools rather than sold directly to individual parents or students in most cases, is often zero. Edukitor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, records, or access, arising from use of the Service.
7. Third-Party Infrastructure
The Service relies on established third-party cloud hosting, storage, content-delivery, and messaging infrastructure providers — which may include, among others, Cloudflare and Google Firebase — to operate. We select and may change these providers over time as part of our ongoing effort to keep the Service reliable and secure, and we are not responsible for outages or issues originating from these third parties' own systems.
8. Changes to These Terms
We may update these Terms from time to time as the Service evolves. Continued use of the Service after an update constitutes acceptance of the revised Terms. We encourage users to review this page periodically.
9. Governing Law
These Terms are governed by the laws of the Republic of the Philippines. Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the appropriate courts of Surigao City, Philippines.
